Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Little Lake Lending website, online application, customer portal, and related online services (together, the "Site"). The Site is operated by Layma, LLC, doing business as Little Lake Lending ("Little Lake Lending," "we," "us," or "our").

Please read these Terms before you use the Site. If you do not agree, do not use the Site.

These Terms apply to use of the Site. They do not replace your loan agreement, privacy notices, or electronic-consent disclosure. If you obtain a loan, that loan is governed by the loan agreement you sign and by applicable law. If there is a conflict between these Terms and a signed loan agreement on a matter relating to the loan itself, the loan agreement controls.

Acceptance

By accessing or using the Site, you agree to these Terms and to our Privacy Policy, Data Collection Practices, and E-Consent notices, as they apply to you.

If you use the Site on behalf of someone else, you represent that you are authorized to bind that person to these Terms. You may not use the Site if you are not able to form a binding contract.

We may ask you to accept these Terms again when you create an account or submit an application. Clicking "I agree," submitting an application, or continuing to use the Site after we post an updated version constitutes acceptance of the version then in effect.

Description of Services

The Site provides information about Little Lake Lending short-term installment loans and, where available, allows eligible individuals to apply for credit, upload documents, review and sign disclosures, manage an account, and communicate with us.

Content on the Site is for general information. It is not an offer of credit until we approve an application and you accept a loan agreement. Nothing on the Site is legal, tax, or financial advice.

We may change, suspend, or discontinue any part of the Site, including hours of availability, features, or supported browsers. We do not guarantee that the Site will be uninterrupted, error-free, or available in every location.

Loan products are not available in all states. Use of the Site from a state where we do not lend does not create a right to obtain a loan.

Eligibility and Age Requirement

The Site is intended for individuals who are at least 18 years old and who can enter a legally binding contract under applicable law. By using the Site, you represent that you are 18 or older.

To apply for a loan, you must also meet the eligibility standards we set for applicants, including those described on our Apply page. Meeting those standards does not guarantee approval.

You agree to provide accurate, current information. You are responsible for maintaining the confidentiality of your login credentials and for activity that occurs under your account. Notify us promptly if you believe your account has been used without permission.

We may refuse access, close an account, or decline to process an application if we believe these Terms have been violated, if information appears inaccurate, or if required by law.

User Conduct

You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms
  • Impersonate another person, misrepresent your identity or affiliation, or submit false or stolen information
  • Attempt to gain unauthorized access to the Site, other accounts, or our systems
  • Probe, scan, or test the vulnerability of the Site, or circumvent authentication or security
  • Introduce malware, floods of automated requests, or other harmful code
  • Scrape, harvest, or index the Site by automated means except for generally available public search engines indexing public pages
  • Interfere with other users' use of the Site
  • Reverse engineer or copy the Site except as allowed by applicable law
  • Use the Site to send spam, chain messages, or unsolicited promotions
  • Post or transmit content that is defamatory, obscene, threatening, or that infringes another person's rights
  • Use the Site if you are an active-duty servicemember or covered dependent seeking a loan we are not permitted to make under the Military Lending Act

We may monitor use of the Site to protect customers, our systems, and our rights, consistent with our Privacy Policy. We may report suspected illegal activity to law enforcement.

Intellectual Property

The Site and its content—including text, graphics, logos, icons, images, layout, software, and compilation—are owned by Layma, LLC, the Big Valley Band of Pomo Indians of the Big Valley Rancheria, or our licensors, and are protected by intellectual-property laws.

"Little Lake Lending," related logos, and "Big Fish Rewards" are trademarks or service marks used by Layma, LLC. You may not use our names or marks without our prior written permission, except to identify our company accurately in a factual way.

We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for its intended purpose: to learn about our services, apply for credit if eligible, and service an account. You may not copy, modify, distribute, sell, or create derivative works from the Site except as we expressly allow.

If you submit feedback, suggestions, or survey responses, you grant us a non-exclusive, royalty-free right to use that feedback to operate and improve our services, without an obligation to compensate you, to the extent allowed by law. Feedback should not include information you wish to keep confidential unless we have asked for that information as part of servicing.

Disclaimers and Limitation of Liability

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL MEET YOUR EXPECTATIONS, THAT CONTENT WILL BE ACCURATE OR COMPLETE, OR THAT DEFECTS WILL BE CORRECTED.

Information about products, rates, or processes may change. Your loan agreement and official disclosures control over marketing or educational copy on the Site.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LAYMA, LLC, THE BIG VALLEY BAND OF POMO INDIANS OF THE BIG VALLEY RANCHERIA, AND THEIR OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE (OTHER THAN AMOUNTS GOVERNED BY A SIGNED LOAN AGREEMENT) WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNT YOU PAID US, IF ANY, SOLELY TO ACCESS THE SITE IN THE TWELVE MONTHS BEFORE THE CLAIM, WHICHEVER IS GREATER. THIS LIMITATION DOES NOT APPLY TO LIABILITY THAT APPLICABLE LAW DOES NOT ALLOW TO BE LIMITED, INCLUDING LIABILITY FOR FRAUD OR FOR INTENTIONAL MISCONDUCT TO THE EXTENT SUCH LIMITS ARE UNENFORCEABLE.

Some jurisdictions do not allow certain disclaimers or limitations. In those jurisdictions, our liability is limited to the greatest extent permitted.

Nothing in these Terms limits rights you have under a signed loan agreement or under a law that cannot be waived.

Governing Law

These Terms, and any dispute arising out of or relating to the Site or these Terms, are governed by the laws of the Big Valley Band of Pomo Indians of the Big Valley Rancheria, without regard to conflict-of-law rules, and by applicable federal law of the United States.

Layma, LLC is a wholly owned economic-development entity of the Big Valley Band of Pomo Indians of the Big Valley Rancheria, a federally recognized Indian tribe. Operation of the Site and of our lending business is an exercise of tribal sovereignty. Nothing in these Terms, and no use of the Site, is a waiver of the sovereign immunity of the tribe, of Layma, LLC, or of any tribal instrumentality, except to the extent a waiver is expressly and separately stated in a written agreement signed by an authorized representative.

If a court or tribal forum of competent jurisdiction finds any provision of these Terms unenforceable, the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver of our right to enforce it later.

You agree that any claim related solely to use of the Site must be brought in an individual capacity and not as a plaintiff or class member in a purported class or representative proceeding, to the extent such a waiver is permitted by applicable law.

Changes

We may update these Terms from time to time. The updated Terms will be posted on this page with a revised effective date. Material changes will apply going forward. Your continued use of the Site after the effective date of a change constitutes acceptance of the revised Terms. If you do not agree to a change, stop using the Site and, if you have an account, contact us about closing online access.
